The Trouble With Trump's Campaigning
I'm not super optimistic that Trump is going to be able to keep his mouth shut or not obstruct or not intimidate witnesses. I think the first thing that the government might do if, you know, defendant Trump engages in conduct that he would argue his part and parcel of campaigning. But there could come a time where these interests collide. The judge in the New York case did not issue any kind of gag order. What seemed to be concerned about were First Amendment issues and interests running into things the government was concerned about.
