Gorse Isn't Addressing the Non Delegation Doctrine at All.
Gorshes: The majority is doing sort of death by a thousand cuts to the administrative state. He says, if the statutory sub section the agency sites really did endow osha with the power it asserts, that law would likely constitute an unconstitutional delegation of legislative authority. Gorsech doesn't address it at all. They don't have any response for this ause they ont feel like they need a response.
