The US Supreme Court could essentially back off and say, do something called mooting a case. The independent state legislature theory was really fringe until very recently. It's not hard to imagine even if they choose to moot this particular case brought on those grounds that you could have a situation where say the Wisconsin Supreme Court throws out current maps in that state for the US House.
