The Shadow Docket and the Death Penalty
In response to the reinstitution of the death penalty in the 1970s, we see the court move toward resolving all remotely contentious emergency applications as a full court. The book tries to document how the Supreme Court handled last minute applications in the death penalty context have become normalized into contexts that have nationwide policy implications. There's certainly I think an alignment and there's a correlation between the shift and the change in membership on the Supreme Court.
