The Energy Charter Treaty and the Arbitration Process

UK-based energy company Rockhopper Exploration had acquired rights to explore an oil and gas field off Italy's Adriatic Coast. But that was as far as it got when Italy passed a law in 2015 banning offshore production within its territorial waters. The company accused Italy of breaking its obligations, and last year arbitrators decided that Rockhopper was entitled to compensation under the Energy Charter Treaty of €190 million plus interest in costs. That's now being challenged by the Italian government. Kyle Ertian Harrow says it's far too much.
