This is a Voting Rights Act case relating to the Alabama and whether it violated the Voting Rights Act by not creating a district. So we are now 58 years from the passage of the original Voting Rights Act, which somehow creates the circumstances in which the Justice Department of the United States is given sway over the legality or the constitutionality of congressional districts in states. And does this case indicate, is it a possibility at this case will indicate a sunsetting of the idea that three generations after the passing of the act, that the federal government has the right to review and control something? I don't know that nobody ever thought about that," he says.
