The Supreme Court's Leak of the Justice's Draft Opinion
There is no precedent for abor on rights in the legal tradition prior to row that establishes a positive right to abortion, including the common law. The leak took so much of the air out of the balloon when the leaked pinion came out - it was a far more muted reaction than it otherwise would have been. Political dimension of this is i think that if they were trying to get the court to shift its position, ah, that didn't happen,. I mean, whatever you think about the decisiona, i think it's rather good that judges are not intimidated, because that was, at least, i think, part of the objective.
