The Pandemic and the Gardener Case

Gardener is one of the most significant covid-19 cases especially within public law that this year bought us it concerns two 2020 policies on discharging hospital patients to care homes. The claimants were relatives of two elderly care home residents out of approximately 20 000 who sadly died during the first wave of the pandemic in 2020. Rosalind 2022 saw a significant amount of litigation arising from the pandemic and i think this is significant because it stems the possibility of individuals bringing human rights claims off the back of this decision in gardener.
