Do We Have Free Will?

Nietzsche thought that man created free will so that man could ordain punishment. If we don't have free will then can we really be punished? In what universe is it even moderately just to be punished? I think this is an issue that Dostoevsky would have wrestled with and it's an issue that we can wrestle with in regards to the trolley problem.
