The Costs and Benefits of Medical Malpractice

There's an entire academic article responding to Thaler and Sunstein. It's called allowing patients to waive the right to sue for medical malpractice. The authors of this paper note that like, of course there are costs to the medical malpractice system. But we also know that when people are punished for bad behavior, they will act to avoid the bad behavior.
