Involuntary Manslaughter in New Mexico
In New Mexico, involuntary manslaughter is killing someone that without malice, but with some sort of level of culpability. The idea is that it's a un-premeditated murder, it's without malice, and it's committed either in the commission of an unlawful act or not amounting to a felony. So if you're committing a misdemeanor and you kill somebody, that can be involuntary manslaughter. In many states, for involuntary manslaughter, someone consciously disregarded a substantial risk to somebody else. That there was a willful disregard of the risk.
