IRBs have for some time been increasingly expected to evaluate the quality of the research as well as the supposed ethics of the research. And what we know about the quality of their decisions is that they are aleatory, that they are they look from the outside like decisions made by chance. The reason we have due process isn't just to treat people fairly. There is no situation in American government where citizens are treated as contemptuously as they are in front of IRBs.
