Is the Equal Protection Clause Applying to Public Institutions?

In 1866, everybody was talking about 40 acres in a mule. How could you possibly do that if you think the Equal Protection Clause applied? They wanted to get people started on their feet after they'd been slaves for many, many years. It was why I said support. What you're doing here is you're trying to distribute benefits rather than enforce criminal sanctions against people.
