Do We Owe Duty to Persons Who Are Now Dead?
In James's example, you only have aunt and James on a desert island. So I think that whether or not you write your will down on a piece of paper or simply express it verbally is simply a red herring. That doesn't really matter. But we might owe duties to a well-functioning social order or to the heirs who have particular expectations. And there you're going to find a gigantic one when somebody says we owe society.
