The Majority Opinion in the Case of Malware Bite
The judge on the majority says that the definitions inherent in something like malware, software used to monitor or gain access to another's computer system without authorization. The judge says that that definition quote lends itself to verification. And I just don't know if you could ever verify that, especially the more subjective aspect of it, which is for the purpose of impairing or disabling a system. Right. If I had to predict, I think this is going back down to the district court.
