The lawsuits are dreamed up by lawyers in connection with the experts that they expect to call on. So even on contingency fee where they will get rich if the suits succeed, sometimes not. The rolled together litigation of 100 or 200 or 500 districts is qualitatively different. And at that point, the potential hit of taking a loss becomes so large that the general counsel may talk to the board saying, yeah, I realize this is not actually meritorious but have you considered paying money to make this go away?
