Do You Think This Is a Violation of the First Amendment?
The first amendment typically bars the government from making a law that prohibits your speech or assembly rights. Garland wanted to make this really clear, and i think he's done the right thing here. He doesn't want to hear any stories in the press about one of his political appointees who, on the eve of the election, is an event for a senatorial candidate or something else. The rules are consistent with the hatch act, which was largely ignored during the trump administration but actually prohibits, in large measure, political activity by folks inside of the department.
