Justice Sotomayor's Response to the Supreme Court's Delegation of Power

Justice Sotomayor warned that the Supreme Court was being asked to serve as the third branch of government changing Congress's words. Chief Justice Roberts had said, you know, this is an issue of such importance doesn't it truly belong with Congress. And I think the response to that is simply well judges must step in where they are empowered to do so or where they think that there's a separation of powers violation going on. That's why judges exist. They exist to be counter majoritarian and undo constitutional violations.
