I think I'm doing it justice this work by Tom Tyler that procedural justice is what what we need to focus on because that's what actually makes people right like the feeling that a fair process has occurred. The idea of focusing on needs rather than rights might give the illusion of fairness where it's not there. This is arguing exactly the opposite and it's arguing that yes I very much agree with you. Oh right yeah it's right it's just that that that it ends there everybody has the feeling that justice has occurred but nothing in fact has has changed.
Poor and black defendants have more legal rights than ever, but that didn't stop mass incarceration. Why is that? We talk about a paper by Paul Butler called "Poor People Lose: Gideon and the Critique of Rights." Plus, we answer the question that’s on everyone’s mind: how to live as an anti-natalist. And Tamler is appalled to discover David's anti-natalist leanings.
