The Court's Decision Isn't a Vote, It's a Decision
An appeals court can certainly side with the legal reasoning of one judge over nine or ten other judges, but it just tells you where the weight of authority is. In some ways, i think that's fair, and i just don't think that this judge's opinion flies. But it does really inject some uncertainty into the proceedings. If there's any question if and when the former president and those around him are indicted, you don't want that to be the test case.
