The Fardened Case: A Case Out of Queensland

Farden is a case that went before the High Court eight years ago. It involved legislation designed in Queensland to keep people in prison after their term of imprisonment had expired. But it was struck down by the New South Wales Parliament, which made the Supreme Court do the dirty work. And so we had a string of cases then after cable, mostly unsuccessful challenges to state legislation on what we would now calling the cable principle.
