There is no logical holdup for a spot. Multiple other jurisdictions have ETF products, which I didn't include a link to that. HSBC has just approved BitcoinETF, but it's based off of US Bitcoin futures. So there will eventually be a US investment in the U.S., so you have to deal with that issue.
