The Unconstitutionality of the University's Point System

The undergraduate college and its point system, that went too far, was found unconstitutional by a vote of six to three. The outcome many believe mirrors the so-called Baki decision of 1978, in which the court said quotas were illegal but race could still be a consideration. For the first time, a majority of the court agreed that diversity was in fact a compelling interest,. It provided specific guidance on how to achieve that diversity without running a foul of the consequences.
