The Supreme Court's Dangerous Return to Its Roots

Amicus With Dahlia Lithwick | Law, justice, and the courts

CHAPTER

John Roberts and the Brennan Center

John Roberts is in some measure an institutionalist he does keep one eye on the credibility of the court with the public. He still has moral suasion to say as an institutional matter but it also seems to be the case that the other conservative justices are kind of thumbing their nose at him. Clarence Thomas has been saying in public that we were a great place to work until John Roberts came along as Chief Justice. They're all attacking each other in public now again at a moment when their oracular silence is necessary to pretend this is just being a judge and not being a political actor.
