The Role of Discipline in Hard Cases
It does make me think of things like the dirty dozen or even moneyball, where you have someone who has discretion. If he was a member of the PEU, the Pokemon enforcement unit, then it would be appropriate. So the question is, do principles in hard cases control judges decisions? Or is the some sense of strong discretion mean they are not bound in any way by the law?
