The judge in Missouri said that this is not really an emergency, and it didn't call for their emergency powers. I would say, when thousands of people stop dying every day of the disease, it will no longer be an emergency. If you accept that this is an emergency, then that would justify sms use of its emergency powers. There will probably be splits in the circuits at some point, so that the supreme court will review the issue.
