The two bystanders who aided Daniel Penny in his chokehold death haven't been charged. One of those bystanders appeared to be black, which I'm sure played a part in some of the news organization's decisions not to focus on him as the racial elements of the story already make for clicky and sensational headlines. Given that the cause of death was ruled compression of the neck, it would make sense that Penny is the object of the charges. That being said, I do think the other two bystanders are critical to Penny's defense and this story.
