All men are created equal was a bludgeon that was used to fight slavery, even though it couldn't win the day. Slavery existed from the first instant of the countrry. The existence of that phrase was a constant drum beat that eventually wore down like drops on a rock. So constitutions could certainly matter for that reason that it is a shared vocabulary at something we've all said we believe in. And then if you act in ways that are not consistent with that, it's at least a problem that you have to work around.
