Penters case opened the door to in a way was, you know, using these sorts of arguments. And I think what's interesting is that state governments use language when they argue before the court as if they're like the people in the nursing homes. They're positioning themselves in a way in this sort of legal doctrine,. Even to equate things that happen in public law to contract law as if the state is a person.
