The Role of Congress in the Iqwa Case

This case is about a lot of things and I guess it makes sense to kind of use the framework of the legal argument that gets made here. What happens is Congress sort of intervenes in the situation and they do so because, you know, according to the Constitution, Congress has the power to what is called regulating commerce with Indian tribes. And so states are essentially saying, you can't tell us what to do in our courts. But the people who are involved are potential adoptive and actually adoptive families.
