The state should generally be able to respond to circumstances of urgency without the use of emergency powers, Justice Rulo says. "I have concluded that in this case the very high threshold for invocation was met," he adds. Kitchrich: In a sense, whatever Rulo ruled didn't really matter. It's just he can make recommendations for how this might go forward.
