Is Twitter Open to Everyone?
On Masterpiece, Kakeshop and Pruneard. I think Pruneard is a bad decision that should be overruled on both the free speech and the takings,. The court made much of the fact that this is open to everybody. But they're not really listening. On Twitter, if you want to just go to the website and look at things, you don't have to sign a contract. If you want to post, you do have to sign it. By now, most Americans who are at all interested in sites like Twitter, they know that they have content moderation.
