Are Rights of Action Based on Equity a Good Idea?
The court has not had a huge effect on education since the Brownvie Board of Education decision. The term equity comes from a pre modern idea of natural law, where justice is more important than written text. There's no limiting principle for the department of justice to decide which righ it's going to sue states to vindicate and which ones it won't. And yes, i'm in favor of the court cuna, waiting.
