And if we don't have rule of law in a society where we know what is being done in our name at the broadest level, i do not mean programmatically, every programme under way. If statutes are being interpreted in a way that means the opposite, then we need to have access to that kind of information. That is what democracy is about. The compromise that we thought we had reached in 19 78 did not allow for secret opinions carving out exceptions to the fourth amendment. Did not allowed for secret statutory interpretations. They didn't even know that that's how the law was being understood.
