Justice Scalia and Luhan wrote an opinion that was utterly inconsistent with those original practices. Cases like McCulloch versus Maryland actually were what were called key Tam actions, where individuals could come to court. And if you could prove that some illegality was occurring, you got like a third of the proceeds.
