Anderson, It's an Earthquake for the Supreme Court as an Institution
i can't recall an episode like this in the supreme court's entire history, and certainly not one our lifetimes. This is a 98 page draft that looks like it's a complete draft opinion purporting to overrule these two critical precedents. We know of prior examples throughout history where opinions that started as majority opinions lost their majority turned intoto sents. But you know, that we are at a point where someone, whether it's a law clerk or one of the justices in dissent, is leaking this draft opinion is a pretty staggering reflection of where we are when it comes to public perception of the supreme court.
