What's the Best Case Result From a School Funding Lawsuit?
In the eighties and nineties, a lot of school funding lawsuits were brought under the terms of each state's state constitution. There was never a lawsuit like that in mississippi because our state constitution has such a weak guarantee to public education now. If you can get a federal declaratory judgment that mississippi is in violation of that statute, then i think at that point you've got a pretty good argument that the state has got to be providing the quality of education that the state constitution called for. We'll just have to see what the state does with it though.
